Anti-spam policy Introduction

Terms of Services/AUP

All services provided by Virtuoso Net Solutions (“Virtuoso Net Solutions”) maybe used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any EU and United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene,or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Virtuoso Net Solutions from any claims resulting from the use of service which damages the subscriber or any other party.Prohibited are sites that promote any illegal activity or present content that may be damaging to Virtuoso Net Solutions’ servers, or any other server on the Internet. Links to such materials are also prohibited. Examples of unacceptable content or links: pirated software,hacker programs or archives,Warez sites…etc



This Acceptable Use Policy document, including the following list of Prohibited Activities, is an integral part of your Hosting Agreement with VirtuosoNetSolutions. If you engage in any of the activities prohibited by this AUP document VirtuosoNetSolutions may suspend or terminate your account.

VirtuosoNetSolutions's Acceptable Use Policy (the "Policy") for VirtuosoNetSolutions Services is designed to help protect VirtuosoNetSolutions, VirtuosoNetSolutions's customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by VirtuosoNetSolutions. VirtuosoNetSolutions reserves the right to modify the Policy at any time, effective upon posting at http://

Prohibited Uses of VirtuosoNetSolutions Systems and Services:

1. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

2. Sending Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of Unsolicited Bulk Email through VirtuosoNetSolutions's servers is prohibited. Likewise, the sending of UBE from another service provider advertizing a web site, email address or utilizing any resource hosted on VirtuosoNetSolutions's servers, is prohibited. VirtuosoNetSolutions accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.

3. Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by VirtuosoNetSolutions customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any VirtuosoNetSolutions-hosted domain, or referencing any VirtuosoNetSolutions account, is prohibited.

4. Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.

5. Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at

6. Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking").

7. Obtaining or attempting to obtain service by any means or device with intent to avoid payment.

8. Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any VirtuosoNetSolutions customers or end-users by any means or device.

9. Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the VirtuosoNetSolutions network or on another provider's network.

10. Using VirtuosoNetSolutions's Services to interfere with the use of the VirtuosoNetSolutions network by other customers or authorized users.

Customer Responsibility for Customer's Users

Each VirtuosoNetSolutions customer is responsible for the activities of its users and, by accepting service from VirtuosoNetSolutions, is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Complaints about customers/representatives or end-users of an VirtuosoNetSolutions customer will be forwarded to the VirtuosoNetSolutions customer's postmaster for action. If violations of the VirtuosoNetSolutions Acceptable Use Policy occur, VirtuosoNetSolutions reserves the right to terminate services with or take action to stop the offending customer from violating VirtuosoNetSolutions's AUP as VirtuosoNetSolutions deems appropriate, without notice. Audio/Video Streaming:

Audio/Video Streaming is not hosting friendly. As such, Virtuoso Net Solutions does not allow any streaming of audio or video content. Offending accounts will be suspended without noticed or terminated. Adult-Oriented Content: Virtuoso Net Solutions does not allow adult content and will suspend/terminate any offending account.

Large File Policy:

Virtuoso Net Solutions is not for file hosting and distribution – as such,customers may not host any large files that are observed to be available for the sole purpose of download. Such files include but are not limited to .ISO, audio/video files, .EXE files. If you are unsure whether your file is against this policy, please e-mail support@Virtuoso Net

Obscene Speech or Materials:

Using Virtuoso Net Solutions’ network to advertise, transmit, store, post, display or otherwise make available child pornography or obscene speech or material is prohibited. Virtuoso Net Solutions is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.

Defamatory or Abusive Language:

Using Virtuoso Net Solutions’ network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language. Forging of Headers: Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message. Illegal or Unauthorized Access to Other Computers or Networks:

Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual’s system (often known as “hacking”). Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity). Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities: Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.

Facilitation a Violation of this AUP:

Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging,flooding, mail bombing, denial of service attacks and piracy of software.

Export Control Violations:

Exporting encryption software over the Internet or otherwise, to points outside the United States.

Usenet Groups:

Virtuoso Net Solutions reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup

violates the AUP.

Other Illegal Activities:

Engaging in activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.

Other Activities:

Engaging in activities, whether lawful or unlawful, that Virtuoso Net Solutions determines to be harmful to its subscribers, operations, reputation, goodwill or customer relations. As we have pointed out, the responsibility for avoiding harmful activities just described rests primarily with the subscriber.

Virtuoso Net Solutions will not, as an ordinary practice, monitor the communications of its subscribers to ensure that the comply with Virtuoso Net Solutions’ policy or applicable law. However, when Virtuoso Net Solutions becomes aware of harmful activities, it may take any action to stop the harmful activity, including, but not limited to, removal of information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or any other action deemed appropriate by Virtuoso Net Solutions.

Virtuoso Net Solutions is also aware that many of its subscribers are themselves providers of Internet services, and that information reaching Virtuoso Net Solutions’ facilities from those subscribers may have originated from a customer of the subscriber or from another third party. Virtuoso Net Solutions does not require its subscribers who offer Internet services to monitor or censor transmissions or web sites created by customers of its subscribers.

Similarly, Virtuoso Net Solutions anticipates that subscribers who offer Internet services will cooperate with Virtuoso Net Solutions in any corrective or preventive action that Virtuoso Net Solutions deems necessary. Failure to cooperate with such corrective or preventive measures is a violation of Virtuoso Net Solutions policy.

Virtuoso Net Solutions will not intentionally monitor private electronic mail messages sent or receive by its subscribers, unless required to do so by law, governmental authority or when public safety is at stake. Virtuoso Net Solutions may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, Virtuoso Net Solutions may disclose information, including, but not limited to, information concerning a subscriber,a transmission made using our network, or a web site, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation or governmental request. Virtuoso Net Solutions assumes not obligation to inform the subscriber that subscriber information has been provided and, in some cases, may be prohibited by law from giving such notice. Finally, Virtuoso Net Solutions may disclose subscriber information or information transmitted over its network where necessary to protect Virtuoso Net Solutions and others from harm, or where such disclosure is necessary to the proper operation of the system. However, Virtuoso Net Solutions will never sell or share information to other services or outside companies.

Virtuoso Net Solutions expects that its subscribers who provide Internet services to others will comply fully with all applicable laws concerning the privacy of online communications. A subscriber’s failure to comply with those laws will violate Virtuoso Net Solutions policy. Finally, Virtuoso Net Solutions wishes to emphasize that, in signing the Service Agreement, subscribers indemnify Virtuoso Net Solutions for any violation of the Service Agreement, law or Virtuoso Net Solutions policy resulting in loss to Virtuoso Net Solutions or the bringing of any claim against Virtuoso Net Solutions by any third party. This means that, if Virtuoso Net Solutions is sued because of a subscriber’s or customer of a subscriber’s activity, the subscriber will be responsible for payment of any damages awarded against Virtuoso Net Solutions, plus costs and reasonable attorney’s fees. We hope this AUP is helpful in clarifying the obligations of Internet users, including Virtuoso Net Solutions and its subscribers, as responsible members of the Internet.
